2. SUBJECT MATTER OF THE AGREEMENT
The subject of this agreement (“Agreement”) is the determination of the rights and obligations of the Parties in accordance with the provisions of the Law No. 6502 on the Protection of Consumers (“TKHK”) and other relevant legislation (collectively referred to as the “Legislation”) in relation to the GastroClub member's purchase of the GastroClub Card by placing an order electronically from the Website and becoming a GastroClub member defined in Article 3 of this Agreement.
3. DEFINITIONS
GastroClub Membership System: It refers to the GastroClub membership system that starts with the delivery of the GastroClub Plastic Card to the GastroClub member for the price specified in this Agreement or when the GastroClub Mobile Card becomes available for use through the GastroClub Mobile Application.
GastroClub Mobile Application: Refers to the mobile application that can work on smartphones, where users can become GastroClub members by purchasing the GastroClub Card within the scope of the Website and GastroClub members can use the GastroClub Mobile Card defined below.
GastroClub Card: Within the scope of this Agreement, the membership card (“GastroClub Plastic Card”) or Iphone, which is sold to the GastroClub member or physically delivered to the GastroClub member by an institution in cooperation with GastroClub (“GastroClub Plastic Card”), which enables the GastroClub member to benefit from discounts, promotions and other campaigns before the restaurants, companies and organizations specified on the Website, It refers to the mobile membership card (“GastroClub Mobile Card”) purchased through the GastroClub Mobile Application via Android phones and tablet computers and used virtually through the GastroClub Mobile Application. The term “Product” used under this Agreement also refers to the GastroClub Card. GastroClub member chooses one of GastroClub Plastic Card or GastroClub Mobile Card to become a member of GastroClub membership System.
GastroClub Member(s): Refers to real and/or legal persons who are GastroClub Card holders who purchased GastroClub Card from GastroClub within the scope of this Agreement and fulfill the membership conditions written in this Agreement.
Website: Refers to the websites under the domain name www.gastroclub.com.tr.
Merchant(s): It refers to the real or legal person under the obligation to provide discounts, promotions and other campaigns specified on the Website to GastroClub members and persons accompanying GastroClub members.
Transaction: It refers to all kinds of product and service relations between GastroClub members and member Merchants.
“Sale Price": Refers to the sale price of the GastroClub Card subject to this Agreement to the GastroClub member.
Party: means each of GastroClub and GastroClub member; GastroClub and GastroClub member are collectively referred to as the Parties.
4. PRODUCT INFORMATION SUBJECT TO THE CONTRACT AND SALE PRICE
The price of the GastroClub Mobile Card is {MobileCard} TL including VAT and shipping. In case of purchase of the GastroClub Mobile Card by the member, the total price of {MobileCard} TL including VAT can be paid by credit card or eft/transfer within the framework of the payment methods selected from the https://www.gastroclub.com.tr/uyeol.htm web address or GastroClub Mobile Application.
If the GastroClub member selects the “recurring payment” option offered by PayU via GastroClub Mobile Application or Website and approves the terms of “PayU Terms and Conditions”, unless the Agreement is terminated by the GastroClub member, accepts, declares and undertakes in advance that this Agreement will be extended for periods as long as the duration of the package purchased in the first place, and in this case, the relevant GastroClub membership fee will be automatically withdrawn from the credit card on due date and by choosing one of the installment options offered by GastroClub.
5. DELIVERY TIME
The GastroClub Mobile Card becomes ready for use as soon as the successful purchase is completed and the GastroClub member will be able to start benefiting from the services of the GastroClub membership System.
6. GASTROCLUB MEMBERSHIP PROCESSES AND GASTROCLUB CARD USE
Persons over the age of 18 who fill out the form on the Website and pay the Sales Price specified in Article 4 of this Agreement, or persons over the age of 18 who fill out the form at the member Workplaces and pay the Sales Price can become a member of GastroClub. membership starts when the Sales Price is collected from the credit card of the GastroClub member upon electronic approval or signature of this distance Agreement and the GastroClub Mobile Card becomes ready for use.
The GastroClub member hereby accepts and declares that he/she has read and informed the preliminary information regarding the basic features of the GastroClub Card, the Sales Price and payment method and delivery in this Agreement and on the Website, that he/she has obtained the basic features of the products ordered, the price of the products including taxes, payment and delivery information correctly and completely, and that he/she has given the necessary confirmation electronically regarding these matters.
The discounts, promotions and other campaigns provided to the GastroClub member within the scope of the GastroClub membership System are applied if the GastroClub member shows the GastroClub Mobile Card to the merchant. If the merchant is in doubt as to whether the GastroClub member is a cardholder, the merchant may request the GastroClub member to present a valid identity card.
Discounts, promotions, restaurants and other campaigns provided within the scope of the GastroClub membership system may vary according to the membership package selected. GastroClub member can only benefit from the restaurants and related campaigns specified in the content of the membership package purchased.
The discounts, promotions and other campaigns provided within the scope of the GastroClub membership System cannot be combined with other promotions and discounts (such as advantages provided by credit cards, other club memberships) made by the Merchant or by third parties authorized by the Merchant. Discounts, promotions and other campaigns provided within the scope of the GastroClub membership system may not be valid in promotional fixed menus prepared by the Merchant; they are only valid in “a la carte” menus within the limits determined by the Merchant. Discounts, promotions and other campaigns provided by various websites and GastroClub membership system advantages cannot be used at the same time. The simultaneous validity of the GastroClub membership System and food vouchers (Sodexho, Ticket, etc.) is at the discretion of the Merchant.
The validity of the discounts, promotions and other campaigns provided to the GastroClub member within the scope of the GastroClub membership System on Valentine's Day, New Year's Day, Mother's Day, Father's Day and similar special days is at the initiative of the member Merchant.
The discounts, promotions and other campaigns provided to GastroClub members within the scope of the GastroClub membership system are not valid for takeaway services, except for the cases specified on the Website and unless specifically stated. GastroClub members who have GastroClub Mobile Card accept, declare and undertake in advance that they cannot benefit from the takeaway service, even if it is stated on the Website. GastroClub members can use the takeaway advantage at the points indicated with the takeaway icon. The takeaway discount rate and the discount rate valid in the restaurant may differ from each other. In order to benefit from the takeaway discount, the GastroClub member must mention that he/she is a GastroClub member when placing an order over the phone, and forward the takeaway code received through the application to the restaurant official who takes the order over the phone. In cases where the code is not transmitted or cannot be verified by the restaurant, the restaurant has the right not to apply the takeaway discount. Takeaway discount is not valid for orders placed through third party websites and / or mobile applications and for payments made with meal cards and checks, except for orders placed by phone to the restaurant.
GastroClub members accept, declare and undertake that the discount rates of certain member Merchants may vary on a day and/or hour basis, that they will follow the noon/evening discounts, weekday/weekend discounts, person limits and/or other special conditions on the Website and / or Mobile Application and that GastroClub shall have no responsibility for any damages, losses and / or other negativities that may otherwise be encountered.
The GastroClub member accepts, declares and undertakes that all information he/she has provided while becoming a member of the GastroClub membership System is correct and complete and not misleading, that he/she is exclusively responsible for any damages and sanctions that may arise from their being incorrect, incomplete or misleading, and that GastroClub will compensate any direct, indirect and all kinds of damages that GastroClub may incur in this direction in cash and immediately. The GastroClub member accepts, declares and undertakes that he/she is responsible for the confidentiality of the user name and password determined by him/her and exclusive to him/her, and that GastroClub shall not be liable for any damages that may be incurred by third parties as a result of the fault or negligence of the GastroClub member and / or for any damages that may be incurred for this reason.
The discounts, promotions and other campaigns provided under the GastroClub membership System and GastroClub Card cannot be transferred to third parties. Only GastroClub members and GastroClub Cardholders who receive services together with the GastroClub Cardholder (if any) up to the person limit determined by the Merchant may benefit from these discounts, promotions and other campaigns. Except for these cases, the use of the GastroClub Card by persons other than GastroClub members is prohibited and any legal and financial liability arising from the use of these cards by others in any manner whatsoever shall be borne by the GastroClub member. In addition to the above, the GastroClub member accepts, declares and undertakes in advance that the GastroClub Mobile Card is paired with the member's mobile device, that the device in question can be changed at most once within a year, that if the number of device changes occurs more than once within the year in which the membership is valid, GastroClub must contact GastroClub via the e-mail address info@gastroclub.com.tr and notify GastroClub about the change in question, otherwise the membership services cannot be used and no claim or objection will be made in this regard.
The Website will be constantly updated in order to display all member Merchants and conditions of participation in an up-to-date manner. GastroClub is not responsible for the consequences of any changes in the conditions of participation of any member Merchant. GastroClub members can benefit from the advantages offered by member Merchants included in the GastroClub system after their membership start date.
GastroClub members are required to make a reservation by specifying the membership in question for the member Workplaces that have a reservation requirement. Whether or not to accept reservations is entirely at the discretion of the member Workplaces and member Workplaces have the right not to accept reservations.
The GastroClub member accepts, declares and undertakes that he/she will make transactions with the consent of the credit card or debit card holder in transactions requiring online payment methods and credit card or debit card use through the Website; otherwise, he/she will be solely responsible for all kinds of expenses and all kinds of damages, including attorney's fees, which may arise from payment refunds, non-performance or similar reasons, and will hold GastroClub harmless from any claims that may arise from them.
GastroClub members earn 1 (one) point if they use a discount for the first time at any restaurant and fill in the 'total amount' tab on the mobile card. The maximum points to be earned with this method is 40 (forty) points. After 40 (forty) points, no points can be earned. The points earned can be used as 1 point, equivalent to 1 TL in membership renewals. Points cannot be converted into cash. Points used in GastroClub membership renewals cannot be combined with other campaigns. GastroClub reserves the right to make changes in the point system.
In the event that the GastroClub member has a complaint or request regarding the services provided by GastroClub within the scope of the GastroClub membership System, the GastroClub member may submit such requests and complaints to GastroClub via the e-mail address info@gastroclub.com.tr and / or by contacting GastroClub at 0 850 304 10 83.
In the event that GastroClub member cannot be provided with services in accordance with the provisions of the Agreement due to reasons arising from the fault of GastroClub within the scope of this Agreement, GastroClub member;

GastroClub shall comply with the provisions of this Agreement, the Preliminary Information Form and the relevant legislation in such complaints and requests.
7. RIGHT OF WITHDRAWAL
GastroClub has the right to withdraw from the contract within fourteen (14) days from the date the Mobile Card becomes ready for use, without any justification and without any legal and criminal liability, provided that the membership advantages are not used. GastroClub accepts, declares and undertakes to stop the membership as of the date of receipt of the withdrawal notification. The term of the right of withdrawal starts to run from the day the GastroClub Virtual Card becomes ready for use.
The GastroClub member will make the notification that he/she has exercised his/her right of withdrawal before the 14-day right of withdrawal period expires, by sending it in writing to the e-mail address info@gastroclub.com.tr. The right of withdrawal notifications sent to the e-mail address info@gastroclub.com.tr must include the information of the GastroClub member, the order number subject to withdrawal, the product and quantity subject to withdrawal and the telephone number.
Pursuant to Article 12 of the Regulation on Distance Contracts, GastroClub is obliged to refund all payments collected from the GastroClub member acting as a consumer, including the costs of delivery of the GastroClub Card to the consumer, if any, within 14 days from the date of receipt of the notification of the GastroClub member acting as a consumer that he/she has exercised his/her right of withdrawal.
In the event that the GastroClub member exercises his/her right of withdrawal as specified in Article 7.2 of this Agreement before the 14-day right of withdrawal period expires, the GastroClub member shall be removed from the GastroClub membership System and the GastroClub Mobile Card shall be automatically canceled as of the date of withdrawal.
However, pursuant to subparagraph (h) of paragraph 1 of Article 15 of the Regulation on Distance Contracts, the consumer cannot use the right of withdrawal in service contracts where the performance of the service is started with the consent of the consumer before the expiration of the 14-day right of withdrawal period of the consumer, and therefore in terms of this Agreement. In this context, the GastroClub member who starts to use the GastroClub membership System services before the 14-day right of withdrawal period expires will not be able to use the right of withdrawal.
8. OTHER MATTERS
The information contained on the Website and smartphone applications and belonging to the member Merchants is provided for promotional and informational purposes only. GastroClub does not give any express or implied commitment or guarantee that the information contained in these media reflects the actual situation of the member Merchants or the products and services they provide.
The member Merchants included in printed marketing materials (brochures, catalogs, flyers, etc.) represent the member Merchants included in the GastroClub membership system as of the moment those materials are printed and the discounts, promotions and other campaigns they provide. GastroClub members accept that there may be missing or excessive member Merchant information in printed marketing materials, and that there may be technical inaccuracies, typographical errors or outdated information from time to time in the information on the Website and smartphone applications.
The information contained on the Website and smartphone applications and belonging to the member Merchants is provided for promotional and informational purposes only. GastroClub does not give any express or implied commitment or guarantee that the information contained in these media reflects the actual situation of the member Merchants or the products and services they provide.
The member Merchants included in printed marketing materials (brochures, catalogs, flyers, etc.) represent the member Merchants included in the GastroClub membership system as of the moment those materials are printed and the discounts, promotions and other campaigns they provide. GastroClub members accept that there may be missing or excessive member Merchant information in printed marketing materials, and that there may be technical inaccuracies, typographical errors or outdated information from time to time in the information on the Website and smartphone applications.
GastroClub member accepts, declares and undertakes that he/she will not engage in any business, transaction or action that stops or prevents the operation of the Website with spam, viruses, Trojan horses and other similar malicious software without limitation, or will not be in any relationship with third parties who engage in such business, transaction or action.
Merchant and GastroClub are independent and separate commercial organizations. GastroClub is a platform that brings together the member of GastroClub and the Merchant, and is in no way the provider, presenter, performance assistant of the services, nor is it the partner, agency, dealer, agent, representative, representative or merchant assistant of the Merchant in any way.
The Merchant is only obliged to sell GastroClub membership to GastroClub members as specified in this Agreement. GastroClub shall only act as an intermediary for the GastroClub member and the Merchant and shall not be a party to the service or sales relationship between the GastroClub member and the Merchant. The products and services to be sold, provided, offered or performed by the Merchant are not under the express or implied commitment or guarantee of GastroClub. As stated above, GastroClub functions only as a platform that brings together the Merchant and the GastroClub member. For this reason, GastroClub cannot be held responsible for any defects or subsequent damages arising from the services provided or products sold by the member Merchant.
GastroClub is not under the obligation to know the events related to the quality, quantity, transportation, delivery, type, price, etc. of the goods or services that are the subject of shopping between the member Merchant and GastroClub members and to be a party to the disputes and to make decisions. In case of possible disputes between the member Merchant and GastroClub members, GastroClub will not be a party to this dispute and therefore will not be responsible for direct or indirect damages arising from such disputes. The member Merchant shall be the sole addressee of the GastroClub member for any possible disputes. The GastroClub member hereby accepts and undertakes under this Agreement that he/she will assert such claims only against the member Merchant, that GastroClub has no express or implied guarantee or commitment in this direction, and that he/she will not make any claim against GastroClub.
The GastroClub member accepts, declares and undertakes that in cases where the products and services sold or provided by the member Merchant through discounts, promotions and other campaigns provided by GastroClub may include the consumption of alcoholic beverages, according to the laws of the Republic of Turkey, he/she is of the age to consume and purchase the alcoholic beverage contained in the product and service in question and that the visuals on the Website and various media, including but not limited to the Website, regarding the products and services in question are in no way encouraging alcohol consumption.
GastroClub is the owner or licensee of the GastroClub Card, the Website, the GastroClub Mobile Application and the related intellectual and industrial property rights. The GastroClub member agrees not to use the whole or part of the Website and/or GastroClub Mobile Application on another website and/or application without the prior written permission of GastroClub; not to modify, copy, reproduce, translate into another language, reverse engineer, republish, publish, upload to another computer, post, transmit, present or distribute any data, including source code, data code and software, contained in the system.
GastroClub may use the identity information of the GastroClub Member for the security purposes of the GastroClub Member and for the performance of GastroClub's obligations arising from this Agreement or for certain statistical evaluations. The GastroClub Member expressly consents to the use of such information by GastroClub for such purposes. GastroClub may classify and store this information on a database. GastroClub may share the name and telephone information of the GastroClub Member with the Merchant for the convenience of making transactions with the relevant Merchant using the telephone number information without the need to use the GastroClub Card.
GastroClub member, the member Merchant is obliged to comply with the Legislation regarding the products and services provided, that it is solely responsible for the proper performance of all kinds of obligations imposed by this legislation on the seller or provider and for consumer demands, and that GastroClub has no liability arising from such violation if the member Merchant violates its relevant obligations, GastroClub accepts, declares and undertakes that GastroClub has no express or implied guarantee and commitment that the Merchant will provide the products and services in accordance with the Legislation and/or in the manner it undertakes, and that it will not make any request from GastroClub for these reasons and will direct its relevant requests only to the Merchant.
By visiting or using the Website or becoming a GastroClub Cardholder, the GastroClub member expressly accepts, declares and undertakes that he/she has read, understood and is bound by the content on the Website, these conditions regarding the use of the GastroClub Card and the Preliminary Information Form, and that he/she will comply with these conditions and all applicable laws, regulations and other legislation.
The Parties hereby agree that the addresses written in this Agreement are their legal notification addresses.
Istanbul Central Courts and Enforcement Directorates are authorized to settle disputes that may arise from this Agreement between the parties. In disputes that may arise from this Agreement, Consumer Arbitration Committees up to the value announced by the Ministry of Customs and Trade, Consumer Courts above the specified value; In places where there are no Consumer Courts, the Civil Courts of First Instance are authorized.
The Parties to this Agreement agree and declare that the books, records and documents of the Parties and GastroClub's voice recordings, written or fax instructions to be sent to GastroClub by the GastroClub member will be the exclusive evidence in accordance with the article of the Code of Civil Procedure No. 6100, and that they will not offer oaths to each other for the proof of any matter in resolving any disputes that may arise between them regarding this Agreement and its implementation.
9. DURATION, TERMINATION AND VALIDITY
This Agreement is valid for {InstallmentNumber} months starting from the date of Gastroclub's collection of the membership fee from the Gastroclub member. The Agreement shall terminate automatically when the said period expires without the need for any warning or notice. Unless the GastroClub member chooses the “recurring payment” option offered by PayU via GastroClub Mobile Application or Website and approves the terms of “PayU Terms and Conditions”, unless the Agreement is terminated by the GastroClub member, GastroClub accepts, declares and undertakes in advance that this Agreement will be extended for the periods initially purchased and in this case, the relevant GastroClub membership fee will be automatically withdrawn from the credit card on due date and by choosing one of the installment options offered by GastroClub.
GastroClub shall have the right to terminate this Agreement at any time, at its own discretion or in the event that the GastroClub member does not fulfill the obligations specified in this Agreement and / or violates the Agreement for other reasons, without being subject to any compensation liability. GastroClub member's right of withdrawal arising from this Agreement, Distance Contracts Regulation and TKHK is reserved.
In case of termination of the Agreement, the GastroClub member will be removed from the GastroClub membership System and the GastroClub Virtual Card will be automatically canceled as of the termination date.
GastroClub member consents to all kinds of commercial electronic messages, SMS and other submissions to be sent by GastroClub regarding the subject of this Agreement. In this context, the GastroClub member accepts and declares that GastroClub may send all kinds of electronic messages, text messages, faxes, etc. for information, marketing, promotions, campaigns and / or advertising purposes without any prior consent from the GastroClub member through automatic search systems such as fax, e-mail, text message, instant messages (push notifications) via the application and / or Website and / or other similar means of communication.
This Agreement was concluded between the Parties on {CurrentDate}.
GastroClub may change the provisions of this Agreement at any time, the changes shall be published on the Website and/or GastroClub Mobile Application by specifying the version number and date of change and shall enter into force on the same date.
The identity and contact information of the GastroClub member below; If this Agreement is made online, it will be filled in electronically by the GastroClub member.
PURSUANT TO THE LAW NO. 6698 ON THE PROTECTION OF PERSONAL DATA

LEGAL BASIS
Protection of personal data is an important issue for GC YEME İÇME HİZMETLERİ ANONİM ŞİRKETİ (hereinafter referred to as “GastroClub”) and/or its affiliated companies. GastroClub, first and foremost, complies with and adopts the principles of the Law No. 6698 on the Protection of Personal Data (“KVK Law”) (Date of Adoption: 24/3/2016 | Date of Official Gazette Published: 7/4/2016 No: 29677); and subsequently adopts the principles stipulated by the Law No. 6563 on the Regulation of Electronic Commerce, the Turkish Penal Code No. 5237 and all other legislation's criminal and administrative sanctions regarding personal data.
GastroClub shows the utmost sensitivity to the security of your personal data and accordingly attaches great importance to the processing and storage of all kinds of personal data belonging to all persons associated with GastroClub in the best possible and careful manner. Accordingly, within the scope of the Law No. 6698 on the Protection of Personal Data (“Law”) and the relevant legislation, as Data Controller, your personal data notified to GastroClub and/or obtained externally by GastroClub may be processed within the framework of the purpose and defined limits explained below.
Within the framework of the explanations made in the Personal Data Processing Policy, we inform you that you will be deemed to have declared that you have given your explicit consent to the processing of your personal data by reading and understanding this Policy within the framework of the explanations made in the Personal Data Processing Policy and that you have declared your acceptance by checking the box “I have read and accept the Privacy and Personal Data Protection Policy” while becoming a member on the site.
1. DATA CONTROLLER
In subparagraph (ı) of paragraph 1 of Article 3 of the Law, the data controller is defined as “Natural or legal persons who determine the purposes and means of processing personal data and are responsible for the establishment and management of the data recording system”. In this context, GastroClub is the Data Controller.
2. FOR WHAT PURPOSE PERSONAL DATA MAY BE PROCESSED
GastroClub will be able to record, store, update, update, disclose to third parties, transfer, classify, process your Personal Data, firstly with your explicit consent, and then in cases and to the extent permitted by the legislation, and will keep it for the period required for these purposes.

The transfer of data between employees or different units operating within the legal entity is not a transfer to a third party in this sense.
4. TRANSFER OF PERSONAL DATA DOMESTICALLY AND ABROAD

GastroClub uses Google infrastructure as an e-mail service provider. If GastroClub is contacted via e-mail, the personal data of the person concerned is kept on Google LLC's servers abroad. Google's privacy policy can be accessed at https://policies.google.com/privacy

5. METHOD AND LEGAL REASON FOR COLLECTING PERSONAL DATA
Your personal data that we process for the above-mentioned purposes can be obtained physically, electronically or through closed circuit imaging systems and other methods. In the processing of your personal data, we adhere to the legal grounds set out in Articles 5 and 6 of the Law, and we seek your consent when required by law.

Personal data shared with GastroClub is under the supervision and control of GastroClub. İşbu sözleşmenin (“Sözleşme”) konusu, GastroClub üyesi’nin İnternet Sitesi’nden elektronik ortamda sipariş vererek GastroClub Kart’ı satın alması ve işbu Sözleşme Madde 3 kapsamında tanımlanan GastroClub üyesi olması ile ilgili olarak 6502 sayılı Tüketicinin Korunması Hakkında Kanun (“TKHK”) ve diğer ilgili mevzuat hükümleri uyarınca (topluca “Mevzuat” olarak anılacaktır) Taraflar’ın hak ve yükümlülüklerinin saptanmasıdır.
GastroClub üyelik Sistemi: İşbu Sözleşme’de belirlenen bedel karşılığında GastroClub Plastik Kart’ın GastroClub üyesi’ne teslim edilmesiyle veya GastroClub Mobil Uygulaması aracılığıyla GastroClub Mobil Kart’ın kullanıma hazır hale gelmesiyle başlayan GastroClub üyelik sistemini ifade eder.
GastroClub Mobil Uygulaması: Akıllı telefonlarda çalışabilen, İnternet Sitesi kapsamında kullanıcıların GastroClub Kart’ı satın alarak GastroClub üyesi olabilecekleri ve GastroClub üyeleri’nin aşağıda tanımlanmış olan GastroClub Mobil Kart’ı kullanabilecekleri mobil uygulamayı ifade eder.
GastroClub Kart: İşbu Sözleşme kapsamında, GastroClub tarafından, GastroClub üyesi’nin İnternet Sitesi’nde belirtilen restoran, şirket ve kuruluşlar nezdinde indirimlerden, promosyonlardan ve sair kampanyalardan faydalanmasını sağlayan, GastroClub üyesi’ne satılıp veya GastroClub’ın işbirliği içinde olduğu bir kurum tarafından fiziki ortamda teslim edilen üyelik kartını (“GastroClub Plastik Kart”) veya Iphone, Android telefonlar ve tablet bilgisayarlar aracılığıyla GastroClub Mobil Uygulaması üzerinden satın alınan ve sanal ortamda GastroClub Mobil Uygulaması üzerinden kullanılan mobil üyelik kartını (“GastroClub Mobil Kart”) ifade eder. İşbu Sözleşme kapsamında kullanılan “Ürün” ifadesi de GastroClub Kart’ı ifade eder. GastroClub üyesi, GastroClub üyelik Sistemi’ne üye olmak için, GastroClub Plastik Kart’tan veya GastroClub Mobil Kart’tan birini seçer.
GastroClub üyesi/Üyeleri: İşbu Sözleşme kapsamında GastroClub’dan GastroClub Kart’ı satın alan ve işbu Sözleşme’de yazılı üyelik koşullarını yerine getiren GastroClub Kart sahibi gerçek ve/veya tüzel kişileri ifade eder.
İnternet Sitesi: www.gastroclub.com.tr alan adı altında bulunan web sitelerini ifade eder.
Üye İşyeri/İşyerleri: İnternet Sitesi’nde belirtilen indirim, promosyon ve sair kampanyaları GastroClub üyeleri’ne ve GastroClub üyeleri’nin beraberinde bulunan kişilere sağlama yükümlülüğü altında bulunan gerçek veya tüzel kişiyi ifade eder.
İşlem: GastroClub üyeleri ile üye İşyeri arasında gerçekleşen her türlü ürün ve hizmet ilişkisini ifade eder.
“Satım Bedeli”: İşbu Sözleşme konusu GastroClub Kart’ın GastroClub üyesi’ne satış fiyatını ifade eder.
Taraf: GastroClub ile GastroClub üyesi’nden her biri anlamına gelir; GastroClub ile GastroClub üyesi topluca Taraflar olarak anılırlar.
GastroClub Mobil Kart’ın bedeli KDV ve kargo dahil kullanıcının satın aldığı pakete göre değişiklik gösterir. Üye tarafından GastroClub Mobil Kart’ın satın alımı halinde KDV dahil toplam üyelik bedeli https://gastroclub.com.tr/Account/Register web adresinden veya GastroClub Mobil Uygulamasından seçilen ödeme şekilleri çerçevesinde kredi kartıyla veya eft/havale vasıtasıyla ödenebilir.
GastroClub Üyesi, GastroClub Üyelik Sistemi’nin aktif hale gelerek üyelik sürecinin başlaması ile birlikte PayU’nun sunmakta olduğu “tekrarlanan ödeme” (recurring payment) özelliğinin yürürlüğe gireceğini ve GastroClub üyesi tarafından Sözleşme feshedilmediği veya Üye’nin gastroclub.com.tr sitesinde kullanıcı girişi yapılarak profil sayfasında yer alan söz konusu “tekrarlanan ödeme” (recurring payment) özelliği manuel olarak kapatılmadığı müddetçe, işbu Sözleşme’nin başta satın alınan paketin süresi kadar sürelerle uzayacağını ve bu durumda her sene ilgili GastroClub üyelik bedelinin vadesinde ve GastroClub tarafından sunulan taksit seçeneklerinden biri seçilerek kredi kartından otomatik olarak çekileceğini peşinen kabul, beyan ve taahhüt eder.
GastroClub Mobil Kart, başarılı satın alma işlemi tamamlandığı anda kullanıma hazır hale gelir ve GastroClub üyesi bunu takiben GastroClub üyelik Sistemi hizmetlerinden yararlanmaya başlayabilecektir.
GastroClub, söz konusu şikayet ve taleplerde işbu Sözleşme, Ön Bilgilendirme Formu ve ilgili mevzuat hükümlerine uyacaktır.
Mesafeli Sözleşmeler Yönetmeliği Madde 12 uyarınca GastroClub, tüketici sıfatını haiz GastroClub üyeleri’nin cayma hakkını kullandığına ilişkin bildiriminin kendisine ulaştığı tarihten itibaren 14 gün içinde, varsa GastroClub Kart’ın tüketiciye teslim masrafları da dâhil olmak üzere tüketici sıfatını haiz GastroClub üyesi’nden tahsil edilen tüm ödemeleri iade etmekle yükümlüdür.
GastroClub üyesi, GastroClub tarafından kendisine işbu Sözleşme konusu ile ilgili olarak gönderilecek her türlü ticarî elektronik iletilere, SMS ve sair gönderimlere onay vermektedir. Bu kapsamda GastroClub üyesi, GastroClub tarafından kendisine, kişi müdahalesi olmadan çalışan faks, elektronik posta, kısa mesaj gibi otomatik arama sistemleri vasıtasıyla, uygulama ve/veya İnternet Sitesi üzerinden anlık iletiler (push notifications) vasıtasıyla ve/veya benzeri başkaca iletişim vasıtaları ile GastroClub üyesi’nden herhangi bir ön izin alınmaksızın bilgilendirme, pazarlama, promosyon, kampanya ve/veya reklam amacıyla her türlü elektronik ileti, kısa mesaj, faks vs. gönderilebileceğini kabul ve beyan eder.
İşbu Sözleşme Taraflar arasında 18/7/2018 tarihinde akdedilmiştir.
GastroClub, dilediği zaman işbu sözleşme hükümlerinde değişikliğe gidebilir, değişiklikler, sürüm numarası ve değişiklik tarihi belirtilerek İnternet Sitesi ve/veya GastroClub Mobil Uygulaması üzerinden yayınlanır ve aynı tarihte yürürlüğe girer.
GastroClub üyesi’nin aşağıda yer alan kimlik ve iletişim bilgileri; işbu Sözleşme’nin internet ortamında yapılması hâlinde GastroClub üyesi tarafından elektronik ortamda doldurulacaktır.
(i) Visa Çözümü yalnızca aşağıdaki koşulları sağlayan kişilerce kullanılabilir:
(ii) 18 yaş üstü ve yürürlükteki mevzuat uyarınca Visa Çözümü’nün kullanımı için öngörülen tüm şartları sağlayan;
(iii) Bilgisayar veya başka bir cihaz aracılığıyla internet erişimi olan; ve
(iv) Bir veya birden çok Uygun Kart sahibi veya yetkili kullanıcısı ve Uygun Kart hesapları iyi durumda olan;
(v) Tüzel kişi adına hareket ediyorsa, en azından Visa Çözümü’nü kullanmak ve işbu Koşullar’ı onaylamak için tüzel kişiyi temsil yetkisi olan kişiler.
a. Bildirimler.
GC YEME İÇME HİZMETLERİ ANONİM ŞİRKETİ [Mersis Numarası- 0389072963100019] (“GastroClub” ya da “Şirket”) tarafından, 6698 Sayılı Kişisel Verilerin Korunması Kanunu’nun (“KVK Kanunu”) ilgili hükümlerine uygun olarak sunulan genel Kişisel Verilerin Korunması Kanunu Kapsamında Aydınlatma Metni ve Gizlilik ve Kişisel Verilerin Korunması Politikası çerçevesinde;
Şirket tarafından alınan tüm kişisel verilerimin, şirket tarafından belirtilen amaçlarla bağlı kalmak kaydıyla, iş geliştirme hizmetlerinin sağlanması, istatiksel ve teknik hizmetlerin temini ve müşteri ilişkilerinin yürütülmesi, uygulama için gerekli ödeme altyapısının sağlanması ile müşteri datalarının tutulması, arşivleme ve depolama amacıyla yurtdışında bulunan iş ortaklarına ve hizmet sağlayıcılarına gereken güvenlik önlemlerinin alınması ile aktarabilecek olup, burada işleme faaliyetine tabi tutulup saklanabilecektir. Çağrı merkezi süreçlerinin yönetilmesine ilişkin hizmetlerin sürdürülebilmesi amacıyla şirket çalışanlarına, görevlilerine, yurtdışı/uluslararası grup şirketlerine (Şirket ve/veya iş ortaklarına, hissedarlarına), kanunen yetkili kamu kurum ve kuruluşlarına, faaliyetlerini yürütebilmek amacıyla, hukuki zorunluluklar ve yasal sınırlamalar çerçevesinde yurtdışı/uluslararası bağımsız denetim şirketlerine, yurtdışı bilişim teknolojileri desteği alınan sunucular, hosting ve altyapı sağlayıcı şirketlere, program, bulut bilişim gibi elektronik ortamlara, tarafıma verilecek hizmetlerin ve/veya faaliyetlerin yürütülmesi için Şirket’in hizmet aldığı veya birlikte çalıştığı Avrupa Birliği üyesi bir ülkede ve Amerika Birleşik Devletleri’nde bulunan iş ortaklarına, hizmet sağlayıcılarına aktarılabileceğini ve bu kapsamda kişisel verilerimin yurtdışına aktarılmasına açık rızam olduğunu kabul ve beyan ederim.
Ayrıca, Şirket ile paylaşmış olduğum kişisel verilerin doğru ve güncel olduğunu; işbu bilgilerde değişiklik olması halinde değişiklikleri Şirkete bildireceğimi kabul ve beyan ederim.
KVK Kanunu kapsamında kişisel verilerimin işlenmesine, ilgili süreç kapsamında açıklanan işlenme amacı ile sınırlı olmak üzere kullanılmasına ve paylaşılmasına, gereken süre zarfında saklanmasına açık rızam olduğunu ve bu hususta tarafıma gerekli aydınlatmanın yapıldığını; işbu metni, Gizlilik ve Kişisel Verilerin Korunması Politikası ve Aydınlatma Metnini okuduğumu ve anladığımı kabul ve beyan ederim.
